Can We Lower The Risk Of Qui Tam Lawsuits?

By Bob Oliver

When fraud is recognized, by anyone, it's easy to see that qui tam lawsuits will be issued. One of the most unique things about fraud is that it can be applied to various entities, ranging from defense contractor practices to the healthcare industry. Even though these lawsuits are troublesome, it's not like they have to be wished out. In fact, from what I have seen, it's just a matter of obtaining as much information as possible, before putting it to use.

Qui tam lawsuits can be reduced in a number of ways, one of them being education. Specifically, business owners should ensure that their employees are familiar with such details as the False Claims Act, a set of guidelines designed to protect whistleblowers. If they report on fraud, it's a certainty that their employment will not be at risk. While this is just one of the first ways to prevent lawsuits, it's an effective strategy that has weight to it.

You should also have a legal counsel on hand. The main reason for this is that no matter how much an individual may not know about the FCA, as mentioned earlier, they still may not be effective at detecting fraud. What this means is that a counsel can be brought on in order to see if there are signs of fraud to be aware of. The sooner that you detect these actions, regardless of the industries they are in, the lower the risk of a lawsuit may be.

Finally, if you're truly stuck on information regarding qui tam lawsuits, do not be afraid to consult the proper authorities. Reputable names such as Whistleblowers Against Fraud know all too well just how common fraud can be, across various industries, and how it can be corrected in the long term. It's just a matter of understanding what different suits entail. These entities will provide you with relevant information, as long as you make the effort to contact them.

It's unfortunate that qui tam cases are pretty common in this day and age. While this situation definitely deserves more attention, preventive measures can be taken, as mentioned earlier. These particular measures will be more than helpful when it comes to keeping the risk of suits down to a lower level. Even though this situation may very well concern people, it's not like there aren't resources worth taking advantage of, either.
