Without Process Servers Vancouver BC Courts Cannot Function

No ordinary person, perhaps not even qualified lawyers, can ever hope to understand all the many laws, rules and regulations that govern everyday life in modern societies. In addition, the entire legal system itself is governed by numerous rules and procedures that must be followed in order to ensure that the system remains fair and just. One such rule is that every person involved in a legal matter is informed of that fact. With process servers Vancouver BC courts make sure that this happens.

The legal system generate mountains of paper work. Lawyers, courts, law enforcement agencies and government departments all produce lengthy and complicated documents and many of them must be served on very specific recipients. This must be done as swiftly as possible. This mammoth task was once the responsibility of the local sheriff but the burden quickly became too big, making it difficult for the sheriff to perform his other functions.

Serving used to be the duty of the sheriff but the volume alone quickly made this impossible. Now, serving professionals dedicated to this single task are responsible for serving legal papers. Most of them are independent, working for several clients and getting paid for each delivery that they make. A server can be employed by a legal firm, by the court, the government, a business or even an individual.

In order to practice as a serving professional it is necessary to obtain a license. The criteria for licensing differ from state to state. In some places applicants need to successfully complete formal training, while in other states they simply need a clear criminal history and a good credit record. Many professionals, which often come from law enforcement backgrounds, hold licences to operate in several states.

It would be very wrong to think that these professionals are nothing but well paid delivery men. A server often has to overcome several obstacles before he can earn his fee. In many cases, the first obstacle is to locate the intended recipient. People move around and some people actively hide from the server because they know that the case cannot proceed until they have been served. Locating recipients can be very time consuming.

Once a recipient is located, he must be served, but this is easier said than done. Most professionals have had to deal with hostile people. There have been numerous cases of violence by such recipients. Unfortunately, even if a violent confrontation is anticipated, the police will not provide protection until the danger actually realizes. In many cases this is too late, resulting in injury and an escaped recipient.

The massive increase in security measures at businesses, apartment buildings, closed estates and private homes also pose a huge obstacle for a server. He may not transgress any trespassing law in order to serve papers. This makes it very difficult to come face to face with the intended recipient, especially if he is trying to avoid being served. This problem can delay delivery significantly.

A successful server needs to be patient and determined. He needs detective skills and he needs to be able to protect himself. They play a very important role in the overall justice system, however.
